Agreement to these terms

These Terms of Use form a binding agreement between you and Brushcrit.com, the operator of Brushcrit (“Brushcrit”, “we”, “us”, or “our”). By accessing or using Brushcrit, you agree to these terms. If you do not agree, do not use the service.

The service

Brushcrit is a tool for creating maps and related creative work. The available features, access conditions, and supported platforms may change over time, particularly while the service is in Beta.

We may modify, add, remove, suspend, or discontinue any part of the service where reasonably necessary.

Eligibility and accounts

You may use Brushcrit only if you can legally enter into this agreement and meet any minimum age requirement in your location.

• You must provide accurate information when registering, joining a waiting list, or contacting us.
• You are responsible for keeping account credentials secure, if accounts become available.
• You are responsible for activity carried out through your account, except where caused by our failure to protect it.
• Brushcrit is intended for users aged 13 or older. If you are below the age of legal majority where you live, you may use the service only with permission from a parent or legal guardian.

Acceptable use

You must use Brushcrit lawfully and must not:

• violate applicable law or the rights of another person or organisation;
• upload, create, distribute, or attempt to distribute unlawful, infringing, harmful, or deceptive material;
• interfere with the service, bypass security measures, probe for vulnerabilities, or introduce malware;
• use automated tools to access the service except where we explicitly permit them;
• reverse engineer, copy, rent, sell, or resell the service except where mandatory law permits it; or
• use Brushcrit in a way that could damage, overload, or impair the service or another user's access.

Your content

You retain ownership of the maps, assets, text, images, and other content that you create or upload to Brushcrit (“Your Content”), subject to the rights of any third parties.

You grant us a limited, non-exclusive, worldwide licence to host, reproduce, process, and display Your Content only as needed to operate, maintain, secure, and improve Brushcrit, and to provide the features you request. This licence ends when Your Content is deleted from the service, except where retention is required by law, maintained temporarily in routine backups, or needed to resolve a dispute.

You confirm that you have the rights and permissions needed to submit Your Content and to grant this licence.

Our intellectual property

Brushcrit and its software, interface, branding, documentation, and other materials are owned by us or our licensors and are protected by intellectual-property laws. These terms give you a limited, personal, revocable, non-transferable right to use the service as made available to you.

Third-party assets, fonts, and services remain subject to their own terms and licences.

Beta

Beta features are experimental. They may contain errors, change substantially, be unavailable, or be withdrawn without notice. Do not rely on Beta features for critical work without keeping your own backups.

If you provide feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation, while you retain ownership of your underlying work.

Disclaimers and limitation of liability

To the maximum extent permitted by law, Brushcrit is provided “as is” and “as available”. We do not promise that the service will be uninterrupted, error-free, secure, or suitable for every purpose.

To the maximum extent permitted by law, Brushcrit is not liable for indirect, incidental, special, consequential, or punitive losses, or for loss of data, profits, goodwill, or business opportunities. Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.

Suspension and termination

You may stop using Brushcrit at any time. We may suspend or end access if we reasonably believe you have breached these terms, created risk for the service or others, or where required by law.

Where reasonably possible, we will provide notice. We may retain or delete information after termination as described in our Privacy Policy and as required for legal, security, or operational reasons.

Governing law and contact

These terms are governed by the laws of the State of Illinois, United States, excluding conflict-of-law rules, unless mandatory consumer-protection law provides otherwise.

We may update these terms when the service or applicable law changes. We will post the new version here and update the “Last updated” date. If a change is material, we will provide additional notice by posting a notice on the website and, where appropriate, by email.
